Martin Pears Engineering Limited is committed to protecting the privacy and security of your personal information.

We ask that you read this privacy policy carefully as it contains important information on who we are, how and why we collect, store, use and share personal information, your rights in relation to your personal information and on how to contact us and supervisory authorities in the event you have a complaint.

WHO WE ARE

Martin Pears Engineering Limited collects, uses and is responsible for certain personal information about you. When we do so we are regulated under the General Data Protection Regulation which applies across the European Union (including in the United Kingdom) and we are responsible as ‘controller’ of that personal information for the purposes of those laws.

THE PERSONAL INFORMATION WE COLLECT AND USE

INFORMATION COLLECTED BY US

In the course of providing goods and services we collect the following personal information when you provide it to us:

  • Your full name, addresses (home, business and or delivery address, as may be applicable), telephone numbers and email address (if provided)
  • Date of birth (when road registering machines)
  • VAT number for self billing invoices
  • Bank details (occasionally)

HOW WE USE YOUR PERSONAL INFORMATION

We use your personal information to:

  • Provide you with equipment, parts goods and services to fulfil your orders
  • For accounting purposes, e.g. producing invoices
  • Register your name address and purchases with manufacturers or suppliers or other warranty providers, for warranty or guarantee purposes or where required to fulfil orders or your other requirements
  • Give to delivery companies (in the event that we engage a third party company) to deliver your orders, if delivery is agreed
  • Provide details to our credit broker or finance companies if finance options are required (see our separate consumer credit policy available on request)
  • Contact you regarding servicing or for promoting our other goods and services (where you have consented to this)
  • Provide you with refunds or payments for purchased goods.

WHO WE SHARE YOUR PERSONAL INFORMATION WITH

We may share your personal information with credit brokers or finance companies (where you are interested in or taking finance products, with manufacturers, suppliers or warranty providers, or to delivery companies. This data sharing enables us to fulfil your orders and as agreed.

We will share personal information with law enforcement or other authorities if required by applicable law.

We will not share your personal information with any other third party without your explicit consent.

WHETHER INFORMATION HAS TO BE PROVIDED BY YOU, AND IF SO WHY

The provision of personal information is required from you to enable us to fulfil our orders and contractual obligations to you.

HOW LONG YOUR PERSONAL INFORMATION WILL BE KEPT

We will normally hold the person information for the period we are required to hold any information by law, or for six years after fulfilment of our contract with you.

REASONS WE CAN COLLECT AND USE YOUR PERSONAL INFORMATION

We rely on our legitimate interests, the requirement to fulfil our contracts with you and any regulatory or statutory requirements as the lawful bases on which we collect and use your personal information. Our legitimate interests are the promotion and sale of our equipment, goods and services. You will not receive direct marketing from us unless you explicitly consent to this and if you do, you will have the right to opt out of direct marketing at any time.

TRANSFER OF YOUR INFORMATION OUT OF THE EEA

We do not normally transfer your personal information to the following which are located outside the European Economic Area (EEA) as follows. In the event that we do need to transfer information outside the EEA, we will seek your explicit consent or take appropriate safeguards to ensure that the recipient is subject to EU standards of data protection (normally by way of EU Commission approved contractual terms or transfer to an organisation in a country deemed by the EU Commission to have an adequate level of data protection similar to those applying in the EEA.

We will not otherwise transfer your personal data outside of the United Kingdom OR EEA or to any organisation (or subordinate bodies) governed by public international law or which is set up under any agreement between two or more countries.

YOUR RIGHTS

Under the General Data Protection Regulation you have a number of important rights free of charge. In summary, those include rights to:

  • access to your personal information and to certain other supplementary information that this privacy policy is already designed to address
  • require us to correct any mistakes in your information which we hold
  • require the erasure of personal information concerning you in certain situations
  • receive the personal information concerning you which you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit those data to a third party in certain situations
  • object at any time to processing of personal information concerning you for direct marketing
  • object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you
  • object in certain other situations to our continued processing of your personal information
  • otherwise restrict our processing of your personal information in certain circumstances

KEEPING YOUR PERSONAL INFORMATION SECURE

We have appropriate security measures in place to prevent personal information from being accidentally lost, or used or accessed in an unauthorised way. We limit access to your personal information to those who have a genuine business need to know it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.

We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

HOW TO COMPLAIN

We hope that we can resolve any query or concern you raise about our use of your information.

The General Data Protection Regulation also gives you right to lodge a complaint with a supervisory authority, in particular in the European Union (or European Economic Area) state where you work, normally live or where any alleged infringement of data protection laws occurred. The supervisory authority in the UK is the Information Commissioner who may be contacted at https://ico.org.uk/concerns/.

CHANGES TO THIS PRIVACY POLICY

This privacy policy was published on 25 May 2018. We may change this privacy policy from time to time and when we do we will inform you via either email or our website.
